http://www.legis.state.pa.us/CFDOCS/...r=1074&pn=1776 I just skimmed this, but basically it says that any "Correctional Institution" that places restraints on a pregnant inmate has some further rules to follow including documentation and reporting. As I read their definition of "Correctional Institution", that includes Constables and Sheriffs. FYI |

WOW! I can see more women are going to try this to wessel out of restraints. Some you can't tell if their pregnant and then some that looks and say something they take offense. Whats next!!!

I just transported a female defendant to the DJ last week who I would have bet was pregnant. Also, she was wearing what appeared to be a maternity type top. I asked her how far along she was in her pregnancy and received a stern look. I also got the "I'M NOT PREGNANT" tongue lashing!

All,
Just read the Act thoroughly. Don't see how this applies to anyone other than County Jail employees. It only applies to inmates, not new arrestees on thier way to jail. After the local jails are comfortable with the new rules, I might want to try to get a copy of thier report form. Reporting for PSCs may only come into play, while transporting an incarcerated & pregnant inmate in her 2nd or 3rd trimester and done only as CYA. But I don't even see an avenue for that in this Act.

It also defines a PRISONER as anyone being detained for a crime. It says "...in a correctional institution..." but since I believe that PSCs fall under that definition, perhaps that part pertains to us as well. I mostly meant when transporting from jail to court, since that person is incarcerated, and you have the authority to detain them as such, I believe that directly applies to you/us. |

I cant tell you the last time I did a transport from jail to the MDJ office well not in county. Out of county transport I have done some but only to the jail and the Sheriffs office did the rest and I transported them back to the out of county jail.

Senate Bill 1074 PN 1619 (Leach) - This bill amends Title 61 (Penal and Correctional Institutions) of the Pennsylvania Consolidated Statutes prohibiting the use of restraints on pregnant women and detainees at correctional facilities except under certain limited conditions. The bill was unanimously reported by a vote of 14-0.
Constables are not Correctional Institutions.

I am assuming your being smart but if not you are authorized by the arrest warrant your issued and trained by PCCD to use restraints.
